Terms of service

These terms are an agreement between you and Beyond Tomorrow Enterprises Pty Ltd (ABN 34 683 765 139) ("we", "us") for your use of CETEChat. By creating an account or using CETEChat you agree to them. If you use CETEChat for a company, you confirm you are allowed to accept these terms for it.

Your account

Keep your password safe. Because your messages are end-to-end encrypted, your password also protects your encryption keys: we cannot recover messages for you if your keys are lost, although teammates' apps can re-share conversations with you after a password reset.

Workspaces

The person who creates a workspace, and the owners and admins they appoint, control who can join it and what members can do. They are responsible for the people they invite.

Acceptable use

Don't use CETEChat to break the law, to harass or harm others, to send spam, to spread malware, or to try to access accounts, workspaces or systems that are not yours. We may suspend accounts or workspaces that do.

There is no tolerance for objectionable content or abusive users. You can report any message or person from inside the app (press and hold a message on a phone, or use the flag next to it on a computer) and block anyone. Reports go to the workspace's owners and admins and to us, and we review them within 24 hours. We may remove content and suspend or remove anyone who breaks these rules.

Your content

You own what you and your team share on CETEChat. It is encrypted so that we cannot read it. You give us only the permission we need to store and deliver it for you.

Plans and payment

The Free plan costs nothing, needs no card, and has the limits shown on our pricing page. Each person can have one Free company that others can join; any other company they create is for them alone until it moves to Business.

Business plan: charged per active member (guests are free), monthly or yearly, in Australian dollars, through our payment provider Stripe. Beyond Tomorrow Enterprises Pty Ltd is not registered for GST, so no GST is added.
Free trial: 30 days. A card is needed to start it, and nothing is charged until the trial ends. We email you 3 days before. Cancel before the trial ends and you pay nothing. Each company, person and card can have one free trial.
Renewal: your plan renews automatically at the end of each month or year until you cancel. Adding or removing people changes the charge from that point, adjusted on your next invoice.
Cancelling: an owner can cancel at any time from Admin, Billing. The Business plan stays on until the end of the period already paid, then the workspace moves to Free. If it has more people than Free allows, owners get 14 days to choose who stays; after that everyone else is paused, never deleted, and comes back if you upgrade again.
Failed payments: if a payment cannot be collected after Stripe's retries, the workspace may move to the Free plan.
Refunds: we do not refund part of a period already paid for, except where the Australian Consumer Law requires it.
Price changes: we will tell workspace owners at least 30 days before a price change affects them.

Availability

We work hard to keep CETEChat running and secure, but we can't promise it will always be available or error free. We may change or improve features over time.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us for CETEChat in the 12 months before the claim (or A$100 if you use the Free plan). Because messages and files are end-to-end encrypted, we cannot recover them if every device that holds the keys is lost.

Nothing in these terms excludes rights you have under the Australian Consumer Law. Where the law lets us limit our liability for breaching a consumer guarantee, it is limited to supplying the service again or paying the cost of having it supplied again.

Ending your use

You can stop using CETEChat at any time. We may suspend or close accounts that break these terms.

Changes

We may update these terms. If a change is significant, we will let you know before it takes effect.

Law

These terms are governed by the laws of New South Wales, Australia.
